Preserving state benefits

If you do not set up a trust to receive your award of personal injury compensation, you will lose your legal right to certain means-tested benefits when you receive it. This also applies to benefits such as long term care provision by a local authority.

Local authorities have discretion as to how they charge for providing care at home (as opposed to care in a home). But they should also disregard your award if it is put in a trust.
