Recent tribunal decisions have clarified liability and scope, with cases considering dual claims for detriment and dismissal, whether external HR consultants might be liable for whistleblowing detriment relating to dismissal decisions, and tribunals awarding substantial compensation for public interest disclosures.

Legislative changes are also reshaping the landscape. The new Employment Rights Act 2025 strengthens protections, adds coverage for sexual harassment disclosures, and limits NDAs. The proposed Office of the Whistleblower Bill signals a move toward centralized oversight.
