This session will provide a useful reminder of some of the basics of a TUPE service provision change and update you on the latest TUPE case law.

When will a service be so fragmented that activities before and after the transfer will not be fundamentally the same? We will consider the recent case of London Care Ltd v Henry and others UKEAT/0219/17.

When will a change to terms and conditions following a TUPE transfer not be void? The  recent  case of Tabberer and others v Mears Ltd and others UKEAT/0064/17 provides a useful example.
